California was the first state in the nation to legalize medical cannabis, through 1996's Proposition 215 (the Compassionate Use Act). Two decades later, voters passed Proposition 64 in 2016, legalizing adult-use cannabis and setting up the eventual merger of the state's medical and recreational frameworks into the Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA). In 2026 we are seeing fresh federal-level developments that California operators can't ignore: the U.S. Drug Enforcement Administration's ongoing rulemaking to reschedule marijuana from Schedule I to Schedule III, and new federal hemp legislation that redefines "hemp" and tightens the rules around hemp-derived cannabinoid products. In almost every case, yes. MAUCRSA requires state licensees to also hold the required local permit or authorization from the city or county where they operate, and the DCC generally will not issue or renew a state license without proof of local approval.
No. Cities and counties are not required to allow commercial cannabis activity, and many have banned it outright or allow only certain license types. Confirming local status before signing a lease or making an investment is a critical first step.
Cannabis licenses generally aren't automatically transferable. A change of ownership, financial interest, or management structure typically requires prior notice to, and often approval from, the DCC and the relevant local authority, which affects deal timing and structure.
Federal rescheduling only partially affects California cannabis businesses right now: it removes the harsh Section 280E tax penalty for state-licensed medical cannabis operations, but recreational/adult-use sales remain unaffected because they stay on Schedule I.
