The passage of Proposition 203 in 2010 opened up the Arizona market to medical marijuana, and since then we have supported Arizona-focused clients with mergers and acquisitions, receivership matters, litigation and general corporate issues. The passage in 2020 of Proposition 207 (i.e. the Smart and Safe Arizona Act) legalized the sale and use of cannabis (subject to certain other conditions), and in some instances, allows those with prior or pending marijuana convictions to seek to have their records expunged.
In January 2021, the Arizona Department of Health Services will begin accepting applications for the establishment of recreational marijuana dispensaries. Under the new Social Equity Ownership Program, created to grant licenses to individuals from communities disproportionately impacted by enforcement of previous marijuana laws, there are also opportunities for owning and operating dispensaries and testing facilities.
